PLEASE READ THESE TERMS OF SERVICE ("AGREEMENT") CAREFULLY BEFORE PURCHASING, ACCESSING, OR USING THE BANNER DESIGN COURSE ("COURSE") OFFERED BY ARIFITY DESIGNS ("ARIFITY," "WE," "US," OR "OUR"). BY ENROLLING IN OR ACCESSING THE COURSE, YOU ("STUDENT," "USER," OR "YOU") AGREE TO BE LEGALLY BOUND BY ALL TERMS HEREIN. IF YOU DO NOT AGREE, DO NOT ENROLL OR ACCESS THE COURSE.
Acceptance Of Terms
These Terms of Service constitute a legally binding agreement between you and Arifity Designs governing your access to and use of the Banner Design Course, all course materials, digital downloads, feedback sessions, community access, and any related services provided through arifity.com (collectively, the "Services").
Your enrollment, payment, or access to any portion of the Course constitutes your full and unconditional acceptance of this Agreement. This Agreement supersedes any prior representations, warranties, discussions, or understandings, whether oral or written, relating to the subject matter hereof.
Eligibility
To enroll in the Course, you must:
- Be at least thirteen (13) years of age. Students under the age of eighteen (18) must have verifiable parental or legal guardian consent prior to enrollment.
- Have the legal capacity to enter into a binding contract in your jurisdiction.
- Not be prohibited from receiving the Course or Services under the laws of the United States or any other applicable jurisdiction.
By enrolling, you represent and warrant that you meet all of the foregoing eligibility requirements. Arifity reserves the right to verify eligibility and suspend or terminate accounts that do not comply.
Course Description And Scope
The Banner Design Course is an online digital education program covering graphic design principles, typography, color theory, Adobe Photoshop techniques, composition, and the production of professional-grade banner assets, with particular focus on the ERLC/Roblox design community context. Course content may include:
- Pre-recorded video lessons and tutorial sessions.
- Downloadable project files, templates, and reference materials.
- Written guides, presentations, and supplementary resources.
- Optional feedback sessions or community interaction (where expressly offered).
Arifity reserves the right to modify, update, or remove Course content at any time for any reason, including to reflect changes in software, industry standards, or platform policies, without liability to you. Where material changes reduce the substantive educational value of the Course, Arifity will make reasonable efforts to notify enrolled students.
Enrollment And Payment
4.1 Purchase
Access to the Course is contingent upon full payment of the applicable enrollment fee at the time of purchase. Prices are listed in United States Dollars (USD) unless otherwise specified. Arifity reserves the right to modify pricing at any time; however, changes will not apply retroactively to completed purchases.
4.2 Payment Processing
All payments are processed by third-party payment processors. By submitting payment, you authorize us to charge your designated payment method for the total amount due. You represent that you are the authorized account holder of the payment method used.
4.3 Taxes
You are solely responsible for any applicable sales taxes, use taxes, value-added taxes (VAT), or similar taxes or levies imposed by governmental authorities in connection with your purchase.
Refund And Cancellation Policy
Due to the instant digital delivery nature of the Course:
- All sales are final. No refunds will be issued once access to any portion of the Course materials has been granted.
- If you experience a technical issue that prevents access to purchased content, you must contact [email protected] within fourteen (14) days of purchase with a detailed description of the issue.
- Chargebacks or payment disputes initiated without first contacting Arifity support will result in immediate and permanent account suspension and may be disputed by Arifity.
Arifity reserves the right to make exceptions to this policy at its sole and absolute discretion on a case-by-case basis.
Intellectual Property Rights
6.1 Ownership
All Course materials, including without limitation video content, audio recordings, written materials, presentations, graphic assets, templates, project files, brand elements, and any derivative works thereof, are the exclusive intellectual property of Arifity Designs and are protected by United States copyright law, trademark law, and applicable international intellectual property treaties.
6.2 Limited Personal License
Upon enrollment and payment in full, Arifity grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Course materials solely for your own personal, non-commercial educational purposes. This license does not constitute a sale of any intellectual property rights.
6.3 Prohibited Uses
You expressly agree that you will NOT, without prior written authorization from Arifity:
- Copy, reproduce, duplicate, record, screen-capture, download (except where expressly permitted), or store any portion of the Course materials.
- Share, distribute, re-sell, resell, sublicense, rent, lease, lend, or otherwise transfer access to the Course or any materials thereof to any third party.
- Upload, post, transmit, or otherwise make available any Course material on any platform, website, forum, social media, file-sharing service, or peer-to-peer network.
- Create derivative works based on the Course materials, including translated, adapted, or modified versions.
- Use any Course material for commercial purposes, including teaching, training, consulting, or client work, without a separate written commercial license from Arifity.
- Remove, alter, or obscure any copyright, trademark, watermark, or proprietary notice embedded in or on any Course material.
6.4 Student Work
Any original design work you independently create during or after the Course remains your own intellectual property. Arifity does not claim ownership over original student-created work. However, if you submit work for feedback or showcase purposes through Arifity channels, you grant Arifity a perpetual, royalty-free, worldwide license to display such work for promotional and educational purposes, with attribution.
Account Responsibilities
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to:
- Not share your account login information with any third party.
- Not permit any other individual to access the Course through your account.
- Notify Arifity immediately at [email protected] if you suspect unauthorized access to your account.
Account sharing constitutes a material breach of this Agreement. Arifity reserves the right to terminate accounts found to be shared, accessed from multiple devices simultaneously in a manner inconsistent with individual use, or otherwise abused, without refund.
Acceptable Use Policy
You agree to use the Course and any associated community resources in a lawful, respectful, and constructive manner. The following conduct is strictly prohibited:
- Engaging in harassment, bullying, discrimination, hate speech, or threatening behavior directed at Arifity staff, instructors, or other students.
- Submitting false, misleading, or fraudulent information to Arifity.
- Attempting to gain unauthorized access to Arifity systems, servers, or networks.
- Using the Course to facilitate any illegal activity.
- Defaming, disparaging, or making false statements about Arifity Designs, its instructors, or its products in any public forum.
Violation of this Policy may result in immediate suspension or termination of access without refund and may subject you to legal action.
Disclaimers Of Warranties
THE COURSE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE COURSE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ARIFITY DOES NOT WARRANT THAT THE SKILLS OR INFORMATION ACQUIRED THROUGH THE COURSE WILL RESULT IN ANY PARTICULAR PROFESSIONAL OR COMMERCIAL OUTCOME.
Arifity is not responsible for any third-party software, platforms, or tools (including Adobe Photoshop, Roblox, or Discord) referenced in the Course. Any such tools are subject to their own separate terms of service and licensing agreements.
Limitation Of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARIFITY DESIGNS, ITS OWNERS, INSTRUCTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE COURSE OR SERVICES, EVEN IF ARIFITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall Arifity's total aggregate liability to you for any and all claims arising out of or related to this Agreement or the Course exceed the total amount paid by you to Arifity in the twelve (12) months immediately preceding the claim giving rise to liability.
Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such jurisdictions, Arifity's liability shall be limited to the maximum extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Arifity Designs and its owners, officers, instructors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Course or Services; (b) your violation of this Agreement; (c) your violation of any applicable law or regulation; (d) your violation of any third-party rights, including intellectual property rights; or (e) any content you submit or transmit through Arifity channels.
Privacy And Data
Arifity collects and processes personal information in accordance with its Privacy Policy, which is incorporated herein by reference. By enrolling in the Course, you acknowledge that Arifity may collect, store, and process your personal information (such as name, email address, and payment information) for the purpose of providing the Course and communicating with you about your enrollment.
Arifity will not sell your personal data to third parties. We may share data with trusted payment processors and service providers solely as necessary to deliver the Services.

Termination And Suspension
Arifity reserves the right to suspend or terminate your access to the Course and Services at any time, with or without notice, for any violation of this Agreement, including but not limited to intellectual property infringement, account sharing, or abusive conduct. Upon termination for cause, you will not be entitled to any refund.
You may terminate your enrollment at any time; however, no refunds will be issued pursuant to Section 5 of this Agreement. Termination of your account does not extinguish any obligation or liability incurred prior to termination.
Sections 6, 9, 10, 11, 14, and 15 of this Agreement shall survive termination.
Governing Law And Dispute Resolution
14.1 Governing Law
This Agreement and all claims, disputes, or controversies arising out of or relating to this Agreement or the Course shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to conflict of law principles.
14.2 Jurisdiction and Venue
You irrevocably consent to the exclusive personal jurisdiction and venue of the state and federal courts located in the State of Wyoming for the resolution of any dispute arising under or in connection with this Agreement. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
14.3 Informal Resolution
Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting [email protected] with a written description of the dispute. The parties shall negotiate in good faith for a period of thirty (30) days following receipt of such notice. If the dispute is not resolved within thirty (30) days, either party may pursue formal legal remedies.
14.4 Waiver of Class Action
YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST ARIFITY.
General Provisions
15.1 Entire Agreement
This Agreement, together with the Privacy Policy and any other policies expressly incorporated by reference, constitutes the entire agreement between you and Arifity with respect to the Course and supersedes all prior or contemporaneous agreements, representations, warranties, or understandings.
15.2 Amendments
Arifity reserves the right to modify this Agreement at any time. Updated terms will be posted at arifity.com with a revised "Last Updated" date. Your continued use of the Course following any amendment constitutes your acceptance of the revised terms. It is your responsibility to review this Agreement periodically. If you do not agree to an amendment, you must discontinue use of the Course.
15.3 Severability
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15.4 Waiver
No failure or delay by Arifity in exercising any right, power, or remedy under this Agreement shall operate as a waiver thereof. Any waiver must be in writing and signed by an authorized representative of Arifity to be effective.
15.5 Assignment
You may not assign or transfer any of your rights or obligations under this Agreement without the prior written consent of Arifity. Arifity may assign this Agreement or any rights hereunder without restriction.
15.6 Force Majeure
Arifity shall not be liable for any delay or failure to perform its obligations under this Agreement due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, governmental actions, internet or platform outages, or other force majeure events.
15.7 Electronic Communications
By enrolling in the Course, you consent to receive communications from Arifity electronically. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
